Contract of Sale & Guarantee of Health



CONGRATULATIONS ON THE PURCHASE OF YOUR NEW PUPPY!!  EVERYTHING HAS BEEN DONE TO INSURE THAT HE/SHE GETS THE BEST START POSSIBLE.  THE PUP HAS BEEN STARTED ON ITS VACCINATION SERIES AND DEWORMING PROGRAMME, AND GIVEN LOTS OF T.L.C. 

Sales Contract

DogPaddle Adventures (hereinafter referred to as "SELLER"), has received the sum of $___________
from (Full Name of BUYER)_______________________________________________________ (hereinafter referred to as "BUYER")

as consideration for the purchase of the Canadian Inuit Dog or Trapline Dog (both hereinafter referred to as "Sled Dog"), described as:

Conditions of Sale

(1) Both BUYER and SELLER acknowledge that no representations, verbal or implied, have been made with regard to said Sled Dog's future abilities. 

(2) SELLER warrants, to the best of his/her knowledge, that said Sled Dog is sound and free from disease and genetic/congenital defects as of the date and time that the Sled Dog leaves the SELLER.  The BUYER has the option to take the Sled Dog, within 72 hours of the date and time of purchase, at their own expense, to a veterinarian of their choice.  If the Sled Dog is found not to be in good health, the BUYER may return the Sled Dog to the SELLER within 5 days of the date of purchase, with the written adverse health report, which must be signed by a licensed veterinarian. 

(3) The Sled Dog is guaranteed until one year of age against genetic/congenital defects which would cause death or the need to be humanely destroyed.  In such an unlikely case, a written veterinarian report, with autopsy if necessary, must be submitted, to the SELLER, in writing and signed by a licensed veterinarian. 

(4) The BUYER agrees that this Sled Dog, and it's prodgeny, will never be registered (or recorded) with an organization or kennel club that does not specifically subscribe to DogPaddle Adventure's "Working Dog Philosophy".  The BUYER further agrees to have no association with any Canadian Inuit/Eskimo Dog conflicting organization or kennel club (relating to Canadian Inuit/Eskimo Dogs), and to not participate with this animal in any kennel club, or conflicting organization registry. 

(5)  The BUYER agrees to provide a healthy job for the Sled Dog, allowing the Sled Dog to be a full-fledged contributing member of the family.  Under no circumstances will the Sled Dog be mistreated, neglected, abused, disrespected, or suffer the phsycological abuse of being degraded to being a family pet. 

Deposit and Refund Policy 

Deposits

All dogs are sold on a first come - first serve basis, therefore a Sled Dog will be held only if a deposit has been received while the dog is still for sale.  Full payment must be received by the SELLER prior to the Sled Dog leaving the SELLER's possession.

All deposits are final and will not be returned or refunded in anyway.  Should the BUYER decide not to complete the transaction, after the deposit has been received by the SELLER, the deposit will be forfeit to the SELLER. 

Refund Policy

(1) Should the BUYER return the Sled Dog to the SELLER for any of the above stated reasons in the section entitled "Conditions of Sale", it will be the SELLER's sole discretion to either:
(a) replace the Sled Dog; or
(b) refund the purchase price. 

(2) If Sled Dog is found to have any genetic/congenital defects (within the first year of it's life), and the buyer decides to keep the dog anyway, the SELLER agrees to: 
(a) Upon receipt of a veterinarian's report, along with a spay/neuter certificate for said Sled Dog, both written and signed by a licensed veterinarian, refund one-third of the purchase price. 

(3) The Sled Dog may not be sold or given away by the BUYER without the prior written consent of the SELLER, who shall have the right of first refusal.  Under no circumstances will the BUYER ever place this Sled Dog in an animal shelter, pound, or pet store of any type. 

The BUYER assumes sole responsibility for every and all expenses incurred relating to said Sled Dog, and agrees that the SELLER is not responsible, under any circumstances, for any expense or occurrence.  All transportation charges are to be paid by BUYER, including those incurred if the Sled Dog is returned. 

This agreement represents the entire agreement between the BUYER and SELLER.  No other agreements or promises, verbal or implied, are included unless specifically sated in this written agreement.
